H.R. 2751, the FDA Food Safety Modernization Act, superseded S.510 and HR 2749 and was signed into law on December 21, 2010. The FDA has already created a search engine to track food recalls:
FDA Updates Website, Launches Search Engine To Track Food Recalls http://www.ihealthbeat.org/articles/2011/4/19/fda-updates-website-launches-search-engine-to-track-food-recalls.aspx
I haven't noticed any major opposition to 2751, including here, and my congressman, who has many small farmers as constituents, supported it, so I suspect that it's not as bad as 2749 was, though time will tell.
Here's what the congressman wrote me:
"I share Vermonters' concerns regarding the safety of our food supply and have been working to pass legislation that addresses this issue without placing an unfair burden on Vermont's small food producers.
Each year, 76 million Americans are sickened from consuming contaminated food, more than 300,000 people are hospitalized, and 5,000 of these people die. In just the last few years, there has been a string of food-borne illness outbreaks in foods consumed by millions of Americans.
Sponsored by Representative Betty Sutton, H.R. 2751 seeks to prevent contamination by requiring food producers to follow new testing and processing guidelines. The bill requires importers of foreign food to verify that products grown and processed overseas meet U.S. safety standards. Finally, the bill expands the authority of the Food and Drug Administration (FDA), allowing it to recall contaminated food and increasing the number of food processing plant inspections the FDA must conduct.
I voted against the original House-passed version of this bill, H.R. 2749, due to the hardships it would have imposed on small farmers and producers. I was pleased that H.R. 2751 included several exemptions for small businesses and producers. Most importantly, it exempts small farms and food manufactures that sell no more than $500,000 a year from certain requirements and removes a provision that required a $500 registration fee for all food producers.
This bill makes a significant investment in protecting the nation's food supply without placing a heavy burden on small food producers. H.R. 2751 passed the House with my support on December 21, 2010."
